The Blind Spot Of Foreign Approvals

Relying blindly on European conformity assessments creates a dangerous regulatory fiction. European oversight relies heavily on Notified Bodies—private commercial entities hired directly by device manufacturers. Over the last decade, high-profile scandals involving metal-on-metal hip replacements and faulty breast implants exposed major cracks in that system.

When those same products transition into the Indian healthcare ecosystem, they encounter a vastly different patient demographic. Genetic variations, anatomical differences, chronic disease comorbidities, and systemic healthcare infrastructure realities diverge sharply between Munich and Mumbai.

To assume that a clinical evaluation performed on a Western cohort maps safely onto an Indian patient without local validation is an administrative convenience masquerading as science. Local clinical investigations were never meant to be mere bureaucratic hurdles. They serve as a final safety check for environmental and physiological compatibility.

The policy treats foreign dependency as a permanent condition rather than a temporary vulnerability. Instead of using regulatory leverage to build sovereign manufacturing and clinical testing capacity, India is outsourcing its safety validation to foreign jurisdictions.

The Traceability Illusion

To offset the loss of localized clinical scrutiny, the government introduced parallel adjustments, including stricter labeling requirements and the elimination of redundant loan licenses for outsourced sterilization facilities. Manufacturers must now print sterilization facility license numbers directly onto product packaging, backed by a six-month transition window.

Traceability is vital, but tracking a defective device after it enters a patient's body is a poor substitute for preventing its failure beforehand.
